Sheriff sued by Cape DA says records sought in suit could cause harm to his office [Video]

A fundamental disagreement over the sheriff’s role in the prosecution is at the heart of a growing legal dispute between the Cape and Islands District Attorney’s office and Duke’s County Sheriff Robert Ogden.

The district attorney, Rob Galibois, said his office is simply trying to meet its obligations. But, the sheriff says he fears producing the records Galibois seeks — 20 years of records that could potentially aid a criminal defendant — could imperil his office by throwing doubt on the record of a corrections officer on the small island of Martha’s Vineyard.

Galibois’ office filed a lawsuit with the Supreme Judicial Court Monday, seeking a court ruling to force Ogden’s office to provide the records, known as “Brady records” in reference to a 1963 Supreme Court decision.
