Teen tries to claw back guilty plea in Charlottesville minimart murder case [Video]

One of the two young men recently convicted in the fatal ambush of another young man at a Charlottesville convenience store, now says he received bad legal advice and wants to vacate his guilty plea on murder and firearms charges.

Orlando Wendell Allen Jr., 17 at the time of the year-ago killing and now 18, says he wants a jury to consider that he committed the lesser offense of voluntary manslaughter because he got shot first in his altercation with Justice Kilel inside the Sunshine minimart on Cherry Avenue.

“I was in shock and pain,” Allen wrote in a recent affidavit. “I wasn’t really thinking. If I was thinking anything, it was to protect my own life at that point.”

Allen came to court Tuesday with a new lawyer for a hearing that had initially been set for sentencing on his two convictions: for second-degree murder and a firearms charge. …
